Membership Terms & Conditions and Policies
By enrolling in and participating in any training, event, or activity at Northern Beaches Jiu-Jitsu Academy (NBJJA), you agree to the following terms and conditions, waiver and release of liability, as well as the policies outlined below. Please read this document carefully.
1. Membership Policies
1.1 Cancellations
You may cancel your membership immediately at any time within the first 4 weeks of membership. After this period, a minimum of 2 weeks’ notice is required for cancellation. You must provide written notice of cancellation via email to info@northernbeachesjiujitsu.com.au.
1.2 Make-Up Classes
If you miss your regular weekly class (eg. due to illness, holidays etc), you may book a make-up class within 4 weeks of the missed class.
To book a make-up class, please email info@northernbeachesjiujitsu.com.au. Make-up classes are subject to availability.
1.3 Public Holidays and School Holidays
Your weekly direct debit payments will continue throughout the year with the following exceptions:
Payments will be paused during the Christmas/New Year shutdown, typically 3–4 weeks.
NBJJA will also be closed on Public Holidays and at Easter. If your regular weekly class is during this time, you are entitled to a make-up class, which must be taken within 12 weeks. To arrange your make-up class, email info@northernbeachesjiujitsu.com.au with your preferred date.
2. Terms and Conditions
2.1 Adherence to Academy Rules
You agree to be bound by all rules and regulations of Northern Beaches Jiu-Jitsu Academy (NBJJA) and to follow any instructions given by the instructors. You acknowledge that failure to comply with the rules may result in the termination of my membership.
2.2 Compliance with Instructor Directions
You agree to obey the instructions of my instructors at all times. You acknowledge that my membership may be terminated at the discretion of NBJJA if you fail to comply with the rules, regulations, or instructions of the Academy.
2.3 Medical Treatment Authorisation
In the event of an accident or injury, you give full consent for NBJJA instructors to administer necessary first aid and/or call emergency services for further assistance.
2.4 Responsibility for Medical Costs
You take full responsibility for any medical or emergency services incurred as a result of any accident, injury, or illness, including contracting COVID-19. You agree to bear all costs associated with such services.
2.5 Fitness to Participate
You affirm that I am physically fit and capable of safely participating in all training activities at NBJJA. The Academy recommends that you seek medical advice before starting any exercise program if you have concerns about my health or fitness.
2.6 Right to Refuse or Cancel Membership
NBJJA reserves the right to refuse, decline, or cancel any membership at any time, with or without reason, at the discretion of the Academy’s management.
2.7 Obligations of the Academy
NBJJA is committed to providing competent instructors and suitable facilities for all lessons. All training sessions will be supervised by qualified instructors trained in the procedures and traditions of Martial Arts.
2.8 Risk Acknowledgment
You understand that the practice of Martial Arts involves inherent risks, including the risk of serious injury or even death. You acknowledge these risks and accept the potential for financial and physical consequences as a result of training.
2.9 Tuition Payment Terms and Obligation to Pay
You understand that my tuition fees are arranged in instalments and are not affected by my lesson schedule or attendance. Failure to attend training does not exempt me from my obligation to pay.
2.10 Liability Waiver
You agree that NBJJA and its officers, instructors, staff, and employees will not be held liable for any injury, damage, or loss caused by or resulting from negligence or any other cause related to my participation in activities at the Academy.
2.11 Indemnification
You agree to indemnify and hold harmless NBJJA, its officers, instructors, staff, and agents from any claims, damages, injuries, or other losses arising from my participation in any activities at NBJJA, including but not limited to personal injury, illness (including COVID-19), and property damage.
3. Waiver and Release Policy
3.1 Assumption of Risk
You fully understand and acknowledge that participation in martial arts events and activities at NBJJA involves inherent risks. These risks include bodily injury, partial or total disability, paralysis, and death. You are aware that these risks can result in significant financial, social, and economic losses. You voluntarily assume all such risks and participate in these activities at your own risk.
3.2 Indemnity Agreement
I agree to indemnify and hold harmless NBJJA, its officers, instructors, staff, and any agents or representatives (the "Indemnified") from any and all claims, damages, injuries, or illnesses (including, but not limited to, COVID-19) that I may sustain while participating in any activities or functions connected with NBJJA, including travel to and from such activities. This indemnity applies regardless of any breach of statutory duty or negligence on the part of the Indemnified.
3.3 Release of Liability
You, on behalf of myself, my heirs, executors, administrators, dependents, and personal representatives, hereby absolve and release the Indemnified from all liability for injury, damage, or loss, including but not limited to personal injury (fatal or otherwise), property damage, or loss of personal belongings, arising out of or in connection with my participation in martial arts or any activities at NBJJA, regardless of whether such injury or damage was caused by the negligence of the Indemnified.
3.4 Photo, Video, and Audio Release
You grant NBJJA permission to capture photographs, video, and/or audio recordings during classes, events, or activities that you participate in. You understand that these materials may be used for promotional purposes, advertising, or sold for profit. You waive any right to compensation or royalties arising from my appearance in such materials.
If you do not wish to grant permission for the use of my image or likeness, you will notify NBJJA by emailing info@northernbeachesjiujitsu.com.au to request that my preferences be respected for future events.
4. Acknowledgment of Understanding
By joining NBJJA, you acknowledge that you have read and understood the terms and conditions, waiver and release agreement, and membership policies outlined above. You voluntarily agree to the terms set forth and accept the risks involved in my participation at Northern Beaches Jiu-Jitsu Academy.
